These terms and conditions (“Terms”) govern the use of the Morbid North online store and all orders placed through it. By using the online store you accept these Terms and agree to follow them.

These Terms shall be governed and interpreted in accordance with the English language, regardless of any translations made for any purpose whatsoever.

We reserve the right to change or update the content of the online store, including changes to prices, product selection or these Terms. In case we make substantial changes to these Terms or Privacy Policy, we aim to notify our Customers in advance on our website and through email.

Please note that companies are not entitled to invoke rights based on Finnish consumer protection legislation.

Morbid North Ltd FI31331275 (online shop) sells products to private persons in Finland and abroad. We reserve all rights to change the terms and conditions, and the prices. All prices include the VAT.

All the prices shown in our online store are in euros.

Customers from non-EU countries are exempt from paying the Finnish VAT but are responsible for possible customs, local VAT and similar expenses in their own country.

Morbid North webstore uses two payment processing services Bambora and Mollie.
Mollie
Apple Pay
Apple Pay is Apple’s own payment method, available in more than 35 countries for all Apple users. It uses the Wallet app, in which a consumer places their payment cards. The actual payment method therefore depends on the cards that are placed in the Wallet app. Currently, only credit cards are supported. The Wallet app stores all details and preferences of the various payment cards it holds. The payment is completed with a fingerprint or face scan. With this, Apple Pay complies with the Strong Customer Authentication (SCA) regulations required under the Payment Services Directive 2 (PSD2).

Credit Cards
Credit card payments fulfilled through Mollie are Mastercard, Visa and American Express.

Klarna
With Klarna: Pay later customers have 14 days to pay after they have received the product. Pay later is available for customers residing in The Netherlands, Austria, Germany, and Finland.
Klarna: Slice It is a flexible payment solution, which allows you various, flexible, ways to pay. By filling out a few simple personal details, customers can cut up the amount due in installments and pay it off in anywhere between 3 to 36 months, with interest or without. Slice it is available from customers residing in Austria, Germany, and Finland.

Visma Pay
Visma Pay (Paybyway Oy, business-id FI24865594) is the payment facilitator of the online shop. Paybyway Oy is a payment facilitator authorized by the Financial Supervisory Authority of Finland. The payment process is conducted in the online service of Visma Pay. Visma Pay or Paybyway Oy is shown as the receiver of your payment in the bank account listing and in your invoice. Paying with Visma Pay is safe. All information is exchanged through secured connections. The trade happens between the online customer and the online shop. Online Banking
With Visma Pay you can pay your order by an internet banking account, a wallet, a payment card (credit/debit), an invoice or a partial payment. You can pay with your MobilePay wallet if you have allowed online payments in the settings of the MobilePay application. Payment via MobilePay takes place directly from the payment card linked to MobilePay. If charging the payment from the linked card fails, MobilePay can not be used in the online shop.

Jousto
Jousto invoice and part-payment is a Finnish service for making purchases quickly and safely. Jousto is for private persons having their economy in balance. With Jousto you will get 30 days time to pay without interest or expenses. After you have received an invoice, you can decide to pay it at once or in parts. You can pay our purchase in up to 36 parts, starting from 9,90 eur/month. Expenses for Jousto part-payment are 3,90 eur/month and 19,90% interest. With Jousto you can pay purchases from 30 to 3000 eur. Aurajoki Nordic Oy issues the credit. Read more from jousto.com.

To place an order you must meet the criteria set for ordering and give true and accurate information of yourself. You must be at least 18 years old to place an order in Morbid North online store.

All orders must be placed online. We do not accept orders via phone or email.

We reserve the right to cancel placed orders. A binding order contract will only be formed when we send you an order confirmation confirming the availability and delivery time of your order.

For orders outside the USA or EU, the customer is responsible for any taxes and duties required by their own country.

Please note that all discounts and promotion codes can be used only once and cannot be combined with other discounts or offers. Discount or promotion codes will not be deducted afterward.

Gift cards are valid forever. Gift cards cannot be exchanged for money.

Your personal data is saved to our customer register. For more information about the processing of personal data please see our Privacy Policy.
shipping and delivery
Orders are being shipped during workdays. Products from the stock are usually delivered within 2-7 workdays. Delivery for products that are not printed-on-demand usually takes 1-3 weeks. Shipping costs are defined by the selected delivery method, possible extra services, shipment weight and size. The shipping costs can be seen in the check-out functionality before confirming the order.

Please inform us without a delay - at least within 14 days - in case a product has lost or damaged in shipping. The logistics company must be also informed regarding any products damaged in shipping.

All orders are shipped with FedEx, Latvijas Pasts, DHL, USPS or DPD. Chosen courier depends between the shipping location and fulfillment center.
Please note that all delivery times are estimates based on average delivery times from our shipping partners, and we cannot guarantee delivery within the estimated time. We are not responsible for any delivery delay. Weekends and holidays are not included in the delivery days.
returns
You have the right to cancel your order containing physical goods, which were placed through the online store, and return the products within 30 days of receiving the order. The returned products must be unused and fit to be resold or gifted to charity. Products must be unused and in good condition without any additional smells, stains or animal hair. All returned items are checked before we make any refunds. If you want to cancel your order, please do so as soon as possible before it ships. After it has shipped, the return will be at your own cost.
Any claims for misprinted/damaged/defective items must be submitted within 4 weeks after the product has been received. For packages lost in transit, all claims must be submitted no later than 4 weeks after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

We highly encourage you to always contact Morbid North first concerning any and all return cases with the form in our Returns page.

Returns cannot be accepted on the following products if the packaging has been opened:
• Products containing CD, LP, DVD and/or Blu-Ray media
• Lingerie and swimwear

The return policy does not apply to:
• Custom made or tailored products
• Sealed products if the seal has been broken
• Digital goods
• Hygene products including face masks

Notification for EU consumers: According to Article 16(c) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for the supply of goods made to the consumer's specifications or clearly personalized, therefore Morbid North reserve rights to refuse returns at its sole discretion.

We are not responsible for delays or damages due to any obstacle beyond our influence. These types of force majeure situations include unusual natural phenomena, disturbances in transportations, and strikes, or trade and export prohibitions.

We are also not responsible for any disturbances, interruptions or downtime of the online store.
Consumers
These terms do not limit Morbid North’s liability under applicable consumer protection laws, such as liability for defects.
The customer must give notice of a defect of an item within a reasonable time from detecting the defect, however, preferably no later than within two months.
Companies
Morbid North is not responsible for any consequential or indirect damage. Our aggregate maximum liability for damages shall be limited to 100% of the purchase price.
Intellectual Property Rights to the Content of the Online Store
The content in Morbid North online store, including pictures, videos, texts, product information, trademarks, and charts are property of Morbid North and/or it’s partners or licensors. Unauthorized use or copying of the contents or material of the Morbid North online store is prohibited.
Personal Data and Data Protection
These Terms are governed by the laws of Finland, excluding its provisions regarding choice of law.

Any disputes that cannot be solved through negotiations between the customer and Morbid North shall be subject to the exclusive jurisdiction of the Finnish courts. Consumers can seek advice from the Finnish Consumer Advisory Services (Kuluttajaneuvonta) or contact the Finnish Consumer Dispute Board (Kuluttajariitalautakunta) for a recommendation.

Online dispute resolution pursuant to Art 14 (1) ODR-VO: The European Commission offers a platform for online dispute resolution (ODR) available under http://ec.europa.eu/consumers/odr/

Dispute resolution before a consumer dispute resolution authority (Section 36 VSBG): We are neither prepared nor obligated to participate in a dispute settlement procedure before a consumer arbitration body.
Contests
Participation in any contests is separate from product orders or other obligations and is intended only for visitors to morbidnorth.com. The participation of service providers or the like offering to participate in the competition is therefore strictly prohibited! Morbid North employees or their relatives are also not allowed to participate in the competition. Just fill out the form and maybe you are one of the lucky winners! The winners are responsible for any importing fees or taxes. All data in connection with the competition will be collected and stored to organize the competition. We do not permanently store any information of the contestants unless you wish to subscribe to our newsletter.
merchandising
General
Morbid North Ltd offers full range of merchandising services including print-on-demand products fulfillment, warehousing, creative and marketing services. Morbid North never holds bands in exclusivity contracts unless separately agreed so. Band has a right to use other services in same time as using Morbid North Ltd. Band has a right to cancel the band account any chosen time by emailing to contact@morbidnorth.com. Account and all contents will be removed in next 14 business days after cancelling the account. If the band has any unpaid profits from sold items, Morbid North Ltd will keep the band account live until all payments are paid. After cancelling, the account will be turned into a basic customer account or deleted completely if requested.

Morbid North Ltd hold the right to cancel band accounts and products at any time or by any reason. Morbid North Ltd hold the right to decline any partnerships with anyone causing possible harm to the Morbid North Ltd brand and image. 
Product restrictions
Morbid North Ltd does not sell content including hate speech, pornography or any content suggesting to do illegal activities. Any adult content like photographic nudity or gore may be censored in main product images. Morbid North Ltd follows the common sense for decent content limitations.
Payments
Morbid North customers have 30 day return period which will also hold on any sales profit payments until the next month after the return period is over. All payments are paid in first week of each month by bands chosen payment method. Some payment methods may include transaction fees or minimum payout restrictions. Band is required to set up the chosen payout option by their own. If the payout is not set by the time of payout, all profits will be paid in next payout date. Band is required to fill their own tax return from all profits gained by their merch sales.
Copyrigth license
By registering your band account you give Morbid North Ltd open commecial license to use your band visual and audio content with open commercial license in products and in marketing. In some case Morbid North Ltd may require separate written license agreement by 3rd party or customs request, legal reasons or by bands own request. Morbid North Ltd and you as a band may hold separate licence agreements. If so then all agreements are under non-disclosure agreement.

Morbid North Ltd never uses any other than content provide by the band without separate permission. By sending your content to Morbid North Ltd, band holds the responcibility that you hold all copyright for the sent content. In all cases if there are a cease on some of the band provided content, Morbid North Ltd will remove that content from the site. If there are any monetary claims on copyrighted content, the band is responcible to handle it on their own. Morbid North Ltd does not hold any responcibility on band provided content.
Creative content rights
Morbid North Ltd may create or adjust print designs for the bands. Some of these are without any additional cost and in any cases when there are no additional contracts, the creative content is made or adjusted by the Morbid North Ltd and thus Morbid North Ltd own the creative assets. Print ready files are never given to the bands and band is not allowed to use design made by Morbid North Ltd by their own or give them to any 3rd party without permission.
Band can use their product mockups freely up until they decide to cancel their account. Mockup images or any other promotional content is not allowed to be used with any other merchandiser than Morbid North Ltd.

All content made by Morbid North Ltd can be bought after cancelling the account in separate contract. If any of the content includes original art. The original artist has a right to compensation of their own. If the content includes stock graphics, music or video. The band is required to buy their own licenses to the content.

Morbid North Ltd may create creative assets like album illustrations or graphic design for 3rd party use. In these cases Morbid North Ltd will create a separate agreement on case-by-case basis. Creative assets created outside of Morbid North Ltd also require separate agreement from the artist.
warehousing
The following terms and conditions (the "Warehousing Agreement") govern all use of the warehousing and fulfillment service (the "Warehousing Services") available on or at the morbidnorth.com website (the "Site"). The Warehousing Services are owned and operated by Morbid North Ltd. ("Morbid North" or “our”). The Warehousing Service is offered subject to your (the "User" or "you") acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on the Site by Morbid North – including, without limitation, Terms of Service, Shipping, Pricing, Return Policy, Privacy Policy and others – each of which is incorporated into this Warehousing Agreement by reference and can be found here: https://morbidnorth.com/terms-of-service/. If you do not agree to this Warehousing Agreement, do not use the Warehousing Services.

By providing the Warehousing Services, Morbid North receives and stores inventory on the User's behalf. Morbid North will prepare the inventory ("Products") for shipment directly to the User's customers ("Customers") upon instructions by the User. Morbid North receives and processes Customer exchanges and returns.

Warehousing Services

Warehousing Services are services that let the User to store various products that comply with the below listed criteria and are owned by the User (“Products”) at Morbid North's warehouse, and Morbid North will pack and ship them to the User's customers when orders come in.

In order to be able to use the Warehousing Services the User must receive Morbid North's prior approval of the Products the User wishes to store by submitting the Products for a review. Morbid North will review whether each Product complies with the following criteria:

1. Is non-perishable;
2. Does not exceed dimensions of 15"x15"x10" inches (or 38x38x25 cm);
3. Is not worth more than $750 a piece (or 700€);
4. Is in conformity with our acceptable content guidelines and Terms of Service.

Morbid North may in its sole discretion review whether the Product submitted for the review or later shipped for warehousing complies with the aforementioned criteria, including but not limited to remeasuring and reevaluating the Product's dimensions, count, value and/or conformity with Morbid North's policies and guidelines applicable to the Warehousing Services. Morbid North reserves the right to either approve or reject the Products, as well as to modify the Product's specification and/or fees applicable for warehousing the Product. The User will be informed about the decision.
Product restrictions
The User is responsible for observing laws, regulations and rules regarding Products and their delivery. The User is prohibited from delivering and selling the following Products:

1. ILLEGAL, RESTRICTED OR PROHIBITED PRODUCTS (WHETHER IN THE USA, EU OR ANYWHERE ELSE WHERE THE PRODUCT IS TO BE SHIPPED), for instance, explosives, drugs, counterfeit products, hazardous materials, contraband or illegal substances, radioactive elements, etc

2. animals, date and temperature sensitive products, perishable products, food and beverages

3. drugs, prescription medications, hormones, steroids, poisonous, toxic or infectious products and substances, medical specimens, pesticides and herbicides

4. weapons, fireworks, fuel, firearms and guns, tear gas, ammunition, military equipment, military and law enforcement equipment

5. products that infringe third party rights (e.g. intellectual property rights) or include and/or portray illegal, hateful or immoral content or elements
Term of Warehousing
After the Product is approved for the Warehousing Services User may store Products with Morbid North for as long term as the User pays Morbid North the applicable fees for the warehousing of the User’s Products (the “Warehousing Term”).
Responsibility and limits
The User is responsible for the manufacturing (is and as applicable) and delivery of Products to Morbid North and all related costs. Morbid North is responsible for safekeeping of Products and damages or losses incurred while they are in Morbid North's possession, however the liability of Morbid North for loss of or damage to any User’s Products stored at Morbid North’s facility is limited to the amount of the value of the Products as stated in the Warehousing Receipt.

Notwithstanding the aforementioned, Morbid North is not liable and you release us from any liability for losses or damages caused by the shipping carrier or in the event of non-delivery due to incorrect address provided by the User or Customer. Morbid North shall under no circumstances be held liable for any special losses due to specific circumstances of the User and/or Customer, indirect or consequential losses or wasted expenditure or if the Product is returned to Morbid North damaged due to the Customer's or shipping carrier's fault. The User will be informed about such returned and damaged Products and they won't be available for stocking or reselling, however, they can still be used for charitable purposes.

Violation of any part of this Agreement or other rules may result in the termination of the User's Morbid North account. Without limiting other remedies, we may limit, suspend or terminate the Warehousing Services and User accounts, prohibit access to our Site, destroy Products, and take technical and legal steps to keep Users off the Site if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter and spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for extended periods of time. It is your responsibility to comply with the terms of the Warehousing Agreement, provide us with true and accurate information about you and your Products and follow your use of the Warehousing Services and any changes or notifications made or published by and/or on behalf of Morbid North on the Site or elsewhere from time to time.
Payments and fees
Payment for the Warehousing Services is based on the fixed fee for warehousing, while the fee for storage is based on specifications (quantity, size of items stored, warehouse location, etc.) of each User and his/her Products individually and can change if the specifications are modified. There is a minimum monthly storage fee set by Morbid North that will be applied to any User using the Warehousing Service, regardless of the amount of Product you store with us. Depending on the location the User has selected for the Warehousing Services, all payments to Morbid North shall be in either U.S. Dollars or Euros. Morbid North at its own discretion reserves the right to change the monthly minimum fees and the User will be informed about such changes.

Unless Morbid North and the User agree otherwise, Morbid North should carry out the Warehousing Services when the User has accepted the payment request in his/her Morbid North account, and the charge for the Warehousing Service has been successful. The User shall be responsible for paying all sales taxes, VAT, GST and other taxes and duties associated with the Warehousing Services (if and as applicable).

In case of non-payment Morbid North at its own discretion can terminate the Warehousing Services according to the procedure set forth in the Warehousing Agreement and destroy and/or donate all User's Products, including damaged items and items with full or partial designs to charity and you hereby waive your right to collect royalties or other fees regarding Products that are destroyed or donated.
Shipping and delivery of products
You are responsible and shall cover all expenses (including but not limited to taxes, duties and shipping costs) and clear customs if and as applicable to your Products and their delivery to the Customer.

Morbid North delivers Products to Customers to most places in the world. There might be some countries we cannot deliver to because of international legal restrictions or shipping carrier limitations.

By using the Warehousing Services the User agrees that some Products can be packaged and shipped separately and the User will cover all shipping costs associated with the Products.
Termination of Warehousing
Morbid North shall have the right to terminate its obligation to store the User’s goods at any time with or without a cause, and especially if the User is in default of its payment obligations toward Morbid North (“Default”) or violates any part of this Agreement or applicable law. In the event of a User’s Default, Morbid North shall have the discretion to require payment of any outstanding charges owed to Morbid North and issue the User a new Warehouse Receipt as a condition of continued warehousing of the User’s Products. Morbid North may demand that the User removes the Products from Morbid North’s facility within a stated period not less than 30 days after the providing of such notice to the User.
Morbid North’s Lien Against User’s Goods
Morbid North shall have a lien on a User’s Products warehoused at Morbid North’s facility as security for the payment of charges owed to Morbid North in relation to the Warehousing Services. If User owes charges to Morbid North for Warehousing Services provided by Morbid North to the User, Morbid North shall have the right to sell any Products stored in Morbid North’s facility in the enforcement of its lien, in accordance with applicable laws.
Abandonment of Warehoused Goods by User
The User storing Products at Morbid North pursuant to a Warehousing Receipt shall have the obligation to retrieve and remove the respective Products from Morbid North’s facility at the end of the storage term. The User may, subject entirely to the discretion and agreement of Morbid North, request Morbid North to dispose of remaining Products stored at Morbid North’s facility which the User does not wish to retrieve. On the receipt of a disposal request by a User (which shall be deemed to be an abandonment of the Products by the User), Morbid North may, at its discretion, destroy or trash the respective Products, or, donate the respective Products to a charity or non-profit organization of its choice, or, sell the Products. Morbid North shall have no obligation to sell the Products, but, in the event of any sale, Morbid North shall have the right to retain the sale proceeds, with no obligation to transfer any of the sale proceeds to the User.

If a User leaves Products at Morbid North’s facility without notice or otherwise providing any information to Morbid North as to the handling of the Products, Morbid North shall have the right to provide written notice to the User (at its last known contact details) that such User has the obligation to retrieve the respective Products from Morbid North’s facility within 30 days after Morbid North has sent the notice. Following the 30 day period, if the User has failed to retrieve its Products from Morbid North’s facility, Morbid North shall have the right to provide a second written notice to the User (at its last known contact details) that such User has the obligation to retrieve the respective Products from Morbid North’s facility within 15 days after Morbid North has sent the second notice. If the respective User fails to retrieve its Products from Morbid North’s facility by the end of the 15 day period pursuant to such second notice, then the respective User’s Products stored at Morbid North’s facility shall be deemed to be abandoned, in which case Morbid North shall have the right to handle the abandoned Products as described herein.
Indemnity
You will indemnify and hold Morbid North (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
Law and jurisdiction
If a dispute arises between you and Morbid North, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Any dispute or claim arising out of or in connection with Services or subject matter or formation (including non-contractual disputes or claims) must be resolved by a court located in the Helsinki, Finland.
General
No agency, partnership, joint venture, employee-employer, franchiser-franchisee relationship, etc. is intended or created by this Agreement. You acknowledge that you have all the necessary permits to grant us with Customers’ personal data to fulfill this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement upon notice to you. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee that we will take action against all breaches of this Agreement.
Affiliate Policy
Our Affiliate Program is meant to encourage you to promote our products, to bring us to new audiences and to make sure that you are rewarded for your activity. It does not create any relationship between us apart from independent contractors; you are not our employee, nor do we have a partnership: if we approve your participation in this program, you are an independent contractor.
This means you should pay all applicable taxes, make sure that you have proper insurance, and not make any statement on our behalf. It also means that we will pay you the sums we agree upon specific dates.
Please understand that our liability to you is limited, as stated in our terms of service, and that we are non-exclusive; we can find other affiliates, and you can market other products.
Intellectual Property
We reserve all our Intellectual Property Rights; and we provide our affiliates a limited, temporary, non-exclusive, non-transferrable, non-sublicensable license to use our trademark, brand name, and promotional materials, and such license is limited only to the use in promoting our products and services with our permitted assets.
This means that you cannot use our Intellectual Property Rights with another brand name or as a bundled project. It also means that you cannot allow others to use the content we licensed to you.

Affiliate Registration
We review and moderate all affiliate registrations, and we appreciate your accurate and honest information. Please note that the review process may take a few days – we know you are eager to join our team of affiliates, and we appreciate your patience!
If you are approved, you will be given a unique referral ID that you can use to promote Morbid North via referral links. Check out your private Affiliate Area for visits and referrals information, creatives, and more.

Affiliate Application
When you apply to become an affiliate we may email you at the email address you have supplied with some questions regarding your application. This may be because:
-We didn’t understand something in your application, or,
-We would like to learn a bit more about how you will promote Morbid North and need some more detail.

If we reach out to you and we haven’t heard back within 7 days, your application may be rejected. If your initial application is rejected, you are welcome to reapply to become an affiliate and provide us with more detail for reconsideration.
Affiliate Rejection
We reserve the right to reject affiliate applications for any reason. We also reserve the right to choose whether we provide an explanation or reasoning for affiliate application rejection. Below are just a few reasons why an application may be rejected (this is not an exhaustive list):
-Affiliate applications for countries that are not part of the countries allowed to participate in the affiliate program.
-Affiliate applications for websites that sell, advertise or engage in pornography, phishing scams, spamming, illegal business practices, or that include any material infringing on National or International Copyright will be rejected.
-Affiliate applications for websites that we do not believe are aligned with our industry or business may be rejected.
-Affiliate applicants with websites that re-sell any of our products will be rejected.
-Websites considered inappropriate by Morbid North will be rejected.

Inappropriate websites:
The following types of sites are not permitted to become an affiliate: adult sites, sites that display adult material or banners, sites that promote violence, hatred or bigotry, sites that promote or engage in illegal activity, including (but not limited to), hacking, cracking, nulled, and warez sites. Affiliate applications for inappropriate websites will be rejected, and we reserve the right to choose whether or not to provide a rejection reason.

Affiliate Termination
We reserve the right to terminate your affiliation with Morbid North, at any time, and with immediate effect, at Morbid North’s sole discretion. When we terminate our relationship, you must cease using all of our Intellectual Property Rights.
In any case we suspect any breach of these terms, we may also suspend your account until we receive sufficient evidence from you that shows that no breach of these terms occurred. In such case, we may require review of your books and records prior to reinstatement.
Upon termination due to breach (save for termination due to inactivity), we shall retain all funds in your account.
Affiliate Notifications
By becoming an affiliate you agree to receive emails from Morbid North These emails will be sent to affiliates only, on an ad-hoc basis, and may include important information regarding the Morbid North affiliate program. These emails will also provide you with relevant news and updates to help you effectively promote Morbid North. As an affiliate you may be privy to embargoed or time-sensitive information in these emails (this information may only be promoted after an embargo is lifted).
Affiliate Commissions
You will earn 7-10% affiliate commission when a customer purchases a new Morbid North plugin license using your referral link during 14 days referral cookie lifetime.
The commission shall be calculated out of our net revenues from your qualified leads, which means our total revenues, minus taxes, chargebacks, cancellations, bad debt, collection costs, clearing costs and payments made in order to collect the payment.
Affiliate Payouts
We pay out affiliate commissions in EUR directly to your bank account or by PayPal in the first week of every month. As we have a 30-day money back guarantee, we only pay commissions that are older than 30 days. The minimum payout balance is 20.00 €, so you receive a decent chunk of cash when payouts come around. And there is no maximum payout balance, so promote Morbid North as much as you like!
In order to receive a payout for your referrals, you must register your bank account or PayPal with our payouts service. Only countries authorized to participate in the affiliate program can receive a payout.
We do not allow referrals to be generated on your own purchases (this includes using a different email address). We do not offer recurring referrals.
Payouts are paid by Sandhills Developement LLC. Morbid North Ltd does not save any bank information for the payouts.
Referral Lifetime
When a potential customer clicks on your referral link, a cookie is stored in their browser to track your referral. The cookie is then stored for a generous 14 days to give your referred customers time to decide if they wish to purchase a Morbid North plugin, or ask us any pre-sale questions they may have.
A referral won’t be awarded if:
-The customer uses a different browser to purchase than the one they originally used to visit our site (because the cookie does not exist in that browser)
-The customer purchases after 14 days (because the cookie will expire).
Referral Rejections
We reserve the right to reject affiliate commissions for any reason. Commission rejections may occur for the following reasons:
-The sale that the referral was based on was refunded
-The method by which the referral was generated was in violation of our promotional policies (see below) or violated the spirit of the Affiliate Agreement.

Referrals older than 30 days and in good standing (i.e. the purchase has not been refunded) will be included with each commission payout (if the commission balance totals 20.00 € or over). If a purchase is refunded, a commission won’t be paid out for that referral.
Promotional Methods
How you promote Morbid North is reflected in the commission you earn. We encourage the use of promotional methods that add value to Morbid North and bring us legitimate, loyal customers.
We love and back our product 100%, and we are very careful with how it is promoted, so we want affiliates who are 100% behind us too. The prohibited promotional methods listed below aren’t meant to scare you off – they are here to protect you, and us, and our customers from any fraudulent activity, which is something we take pretty seriously. We know you will understand. But here they are in writing just in case you’re not totally sure what is and what isn’t allowed.

Morbid North may not be promoted on coupon or deal sites
Customers who are searching for a coupon are already in the market for Morbid North, so this method adds no value to Morbid North. Additionally, we do not offer affiliate discount codes.

Promoting incorrect or misleading information
Any promotional activity that shares incorrect or misleading information will result in affiliate account deactivation. This includes false information intended to click-bait potential customers. If you are unsure of the correct information or details for promoting Morbid North, please contact us.

Paid advertising using your affiliate link is prohibited
Buying ads through services like Google AdWords, social ads, or retargeting ads and using our brand keywords and your affiliate link will result in affiliate account deactivation.

Any type of spam is prohibited
Links, ads, emails, comments, any type of spam. Please respect the posting rules of any 3rd-party websites you use to promote Morbid North. P.S. This is not an exhaustive list of spam methods; if we decide that your activity is spam, it is spam.

Any illegal activity or activity deemed offensive by us is prohibited
This may result in referrals being rejected and/or your affiliate account being deactivated.

Please don’t pretend to be professionally associated with Morbid North
Affiliates aren’t employees of Morbid North or Themeone, and have no employee rights.

Pretending to actually be Morbid North is prohibited
Please don’t do this. Cloning our site, copying our site, using our copyrighted site assets, and pretending that a site created by you is an official Morbid North site is unethical and prohibited (this includes using services that automatically clone websites, or place them into iframes). If you need content or specific graphics, please ask, and we may be able to provide it to you.

Again, false promotion to customers that you are endorsed or operated by Morbid North is prohibited.

If you are unsure or concerned that some activity you are about to proceed with may be considered prohibited, please ask us.

Consequences of using prohibited promotional methods
If your promotional methods step outside of these terms, your referrals may be rejected and we may disable your affiliate account. We reserve the right to take this action and may or may not notify you in the instance that this occurs.

Entire Agreement
By accepting these terms and conditions you are providing your nonlegal agreement to abide by them. By registering and being approved as an affiliate in our affiliate program you agree that your commissions are subject to approval before they are accepted and subsequently paid.
The affiliate relationship does not represent a professional or formal agreement, and as an affiliate you are not an employee of Themeone. You agree that this is not a legally binding relationship and as a result may not take legal action against Themeone. These affiliate terms and conditions are subject to change without notice.
